UAE notice period on resignation: fitting 30 to 90 days between visa grant and your start abroad
Tips · 2026-10-19 · 10 min read

Your UAE notice period on resignation is set by Article 43 of the UAE Labour Law: written notice of at least 30 days and no more than 90 days, with the exact length in your contract. If you leave without serving it, you owe your employer a notice period allowance. For a move to Australia or New Zealand, the calm order is visa grant first, written resignation second, and a start date that leaves room for your notice and your final settlement.
This guide is for professionals and trade workers in Dubai, Abu Dhabi or Sharjah who hold an offer abroad, or expect one soon, and want to leave on good terms with every dirham they are owed.
What Article 43 actually requires
The private-sector rules sit in Federal Decree Law No. 33 of 2021 Regarding the Regulation of Employment Relationships, known simply as the UAE Labour Law. Article 43 lets either side end the employment contract, provided the notice is in writing.
The law sets a floor and a ceiling. Notice cannot be shorter than 30 days or longer than 90 days, and your contract fixes the figure within that range. Senior and specialist contracts often sit nearer the top, so check yours before you promise an Australian or New Zealand employer a date.
The UAE government explains these rules in plain language on its page about terminating employment contracts in the private sector. Keep that page and your signed contract side by side when you plan.
Written notice is the trigger
Your notice period runs from the day your written resignation is given. A conversation with your manager is a courtesy; the letter or email is what starts the count. Keep a dated copy, and ask for written acknowledgement of the date your notice began.
Resigning without notice: what it costs
Searches for "resign without notice UAE" usually come from people whose new employer wants them sooner than their contract allows. The law does not stop you leaving early, but it does put a price on it.
Under Article 43, the party who fails to serve the notice period must compensate the other party with a notice period allowance. In practice, that is often taken from the wages and benefits your employer would otherwise pay you at the end, so an early exit can shrink your final settlement.
If your employer is willing to release you sooner, record that agreement in writing, with the agreed last working day, before you book a flight. A verbal "we will sort it out" is no protection when the final figures are calculated.
Not the same as arbitrary dismissal
Some people confuse the notice allowance with Article 47. That article covers arbitrary dismissal by the employer and caps the compensation at the employee's wage for three months. It protects you when you are dismissed unfairly; it does not apply to a resignation you choose to make.
Resigning during probation
Probation in the UAE private sector cannot exceed six months, and resigning within it follows separate rules. Which rule applies depends on where you are going next.
- Leaving the job and the UAE: you must give prior written notice of 14 days.
- Joining another UAE employer: written notice of at least one month.
- Coming back soon: if you return to the UAE within three months on a new work permit, the new employer must compensate your previous employer for recruitment costs, unless agreed otherwise.
There is a further consequence to weigh. Under Ministerial Resolution No. 47 of 2022, a worker who ends the employment relationship during probation without a breach by the employer cannot get a new UAE work permit for one year. If an Australian or New Zealand plan could fall through, that ban removes your fallback in the UAE.
Lining up your notice with an overseas start date
The most expensive mistake is resigning before the visa decision. Hiring decisions rest with employers, and visa decisions with the Department of Home Affairs or Immigration New Zealand. Our own guidance is the same: wait until you hold a confirmed offer and the necessary approvals before you resign, end a lease or commit money in the Gulf.
Once the visa is granted, each destination brings its own timing.
- Australia: a subclass 482 holder who is outside Australia when the visa is granted must begin employment within 90 days of entering Australia. Our guide to the 482 Skills in Demand visa sets out the streams, and Home Affairs lists the conditions on its Core Skills stream page.
- New Zealand: Immigration New Zealand shows Accredited Employer Work Visa processing as 80% within 5.5 weeks. That is a guide to pace, not a promise, so do not resign on the strength of it. See our AEWV guide for how the employer-led process works.
The table below shows how the UAE rules and your move fit together.
| Stage | Rule that applies | What it means for your plan |
|---|---|---|
| Visa granted | 482 work must begin within 90 days of entering Australia | Resign now, not earlier; agree a start date that covers your notice |
| Notice period | Article 43: 30 to 90 days in writing | Your contract figure decides the earliest realistic last day |
| Notice cut short | Notice period allowance owed by the party who fails to serve | Agree any early release in writing or expect a deduction |
| Last working day | Final dues within 14 days of the contract ending | Allow for the settlement before you fly |
| Visa cancelled | ICP grace period of 30, 90 or 180 days | Know your category; staying beyond it costs AED 50 a day |
Final settlement and visa cancellation
Once your contract ends, your employer must pay all outstanding wages, other entitlements and gratuity within 14 days. Gratuity is worked out on your last basic salary, without allowances such as housing or transport, and nothing is due for less than 1 year of service. Our explainer on how the end-of-service gratuity is calculated walks through the figures, and the government's end-of-service benefits page has the official wording.
Cancellation follows a fixed order. Your employer first applies to MOHRE to cancel the labour contract and labour card, which you also sign, and then applies to ICP to cancel the residence visa. With the MOHRE application, the company must submit a letter from you confirming receipt of all wages and end-of-service benefits. Read your settlement figures before you sign that letter.
After cancellation, ICP grants a grace period: 30 days as standard, 90 days for skilled workers in levels 1 to 3 and property owners, and 180 days for Golden, Green and Blue Residence holders and their families, among other listed groups. Details are on the ICP cancellation of residency permits service, and our briefing on the UAE visa cancellation grace period shows how to use those windows.
A resignation plan, step by step
- Read the notice clause in your contract and note your figure between 30 and 90 days, plus whether you are still on probation.
- Wait for the visa grant and a written offer. Do not resign on a listing, an interview or a processing estimate.
- Agree a start date with the overseas employer that covers your full notice and a few days for the final settlement.
- Request your UAE police certificate while you still have a valid Emirates ID, if your visa needs one. The Ministry of Interior certificate is valid for 30 days from issue and the Dubai Police certificate for 3 months, so time it close to when you lodge.
- Hand in a dated written resignation, keep a copy and ask for written acknowledgement.
- Check the final settlement against your basic salary, unused entitlements and any notice allowance before you sign the MOHRE wages letter.
- Confirm the residence visa has been cancelled, note your grace period and book your flight inside it.
Whether you are heading to a site role such as a carpenter position in Christchurch or an office post in Sydney, the same order keeps your exit clean.
Common mistakes
- Resigning before the visa is granted. If the decision is delayed or refused, you may have lost both jobs.
- Promising a start date without reading the contract. A contract at the top of the 30 to 90 day range cannot be squeezed into a month without an allowance or a written release.
- Treating a verbal early release as settled. Without written agreement, a notice period allowance can still be deducted from your final pay.
- Quitting during probation without checking the one-year ban. Under Ministerial Resolution No. 47 of 2022, it can block a new UAE work permit if your plans change.
- Signing the wages letter before checking the figures. That letter confirms you received everything you were owed.
- Leaving the police certificate until after cancellation. Applying from outside the UAE is possible, but it adds steps you could avoid.
Frequently asked questions
What is the notice period for resignation under UAE labour law?
Article 43 of the UAE Labour Law lets either party end the contract with written notice of not less than 30 days and not more than 90 days. Your own contract sets where you fall in that range, so read the notice clause before you plan any dates.
Can I resign without notice in the UAE?
You can leave without serving the notice, but the law does not make it free. The party who fails to serve the notice period must compensate the other with a notice period allowance, which is usually settled against what your employer owes you at the end.
How much notice do I give if I resign during probation to move abroad?
If you resign during probation intending to leave both the job and the UAE, you must give prior written notice of 14 days. Resigning during probation to join another UAE employer needs at least one month, and a one-year work permit ban can apply when you leave during probation without a breach by the employer.
When should I hand in my resignation for a job in Australia or New Zealand?
After the visa is granted, not before. Count back from the start date in your offer, allow for your full notice period and the final settlement, and remember that a subclass 482 holder outside Australia at grant must begin work within 90 days of entering the country.
How long does my UAE employer have to pay my final dues?
All outstanding wages, other entitlements and gratuity must be paid within 14 days of the contract ending. The company also has to give MOHRE a letter from you confirming you received your wages and end-of-service benefits before the labour contract is cancelled.
Key takeaways
- Article 43 sets UAE notice at 30 to 90 days in writing; your contract fixes the figure.
- Skipping notice means owing a notice period allowance, often taken from your final pay.
- During probation, leaving the UAE needs 14 days' written notice; check the one-year permit ban.
- Resign after the visa grant, with a start date that covers notice and settlement.
- Final dues are due within 14 days, then MOHRE and ICP cancel your contract and visa.
