Resigning during probation in the UAE to leave the country? Weigh 14 days' notice against a one-year ban

Tips · 2026-10-21 · 10 min read

A South Asian professional holds a phone beside a half-packed suitcase in a Dubai apartment at dusk.

If you resign during probation in the UAE and plan to leave the country, the law asks for 14 days' prior written notice, far less than the 30 to 90 days that apply once probation is over. The catch is what follows: ending the job during probation without a breach by your employer means no new UAE work permit for one year. So the considered order is visa granted abroad first, written resignation second, and a clear plan for final pay, visa cancellation and your flight inside those 14 days.

This guide is for people who started a new role in Dubai, Abu Dhabi or Sharjah and then received the sponsored offer in Australia or New Zealand they had been waiting for. The timing is awkward, but it is manageable when you know which rule you fall under.

Probation in the UAE: the rules in brief

Private-sector employment in the UAE is governed by Federal Decree Law No. 33 of 2021, the UAE Labour Law. Probation under that law cannot run longer than six months, and resigning within it follows its own notice rules rather than the standard ones.

Which rule applies depends on where you go next. The UAE government sets them out on its page about employment contracts in the private sector.

If your probation has already ended, the last row is yours, and our guide to the UAE notice period on resignation covers it in detail.

The one-year work permit ban: the fallback you give up

Under Ministerial Resolution No. 47 of 2022, a worker who ends the employment relationship during probation without a breach by the employer cannot get a new UAE work permit for one year. The UAE government explains this on its page about terminating employment contracts.

For someone heading to Australia or New Zealand, the ban rarely matters if the move goes ahead. It matters a great deal if it does not. A refused visa, a withdrawn offer or a delayed start could leave you outside the UAE with no way back into work there for a year.

The rule turns on whether your employer breached the contract. If you believe that has happened, put your question to the Ministry of Human Resources and Emiratisation (MOHRE) before you resign, rather than assuming the ban will not apply. The UAE government lists MOHRE on 009716-802-7666, by email at ask@mohre.gov.ae, or by live chat.

The three-month return rule

A separate rule covers people who leave during probation and come back quickly. If you return to the UAE within three months on a new work permit, your new employer must compensate your previous one for recruitment costs, unless they agree otherwise. Few employers welcome that bill, so a quick return after a failed move is harder than it looks.

Time the resignation to the visa, not the offer

Hiring decisions rest with employers, and visa decisions with the Department of Home Affairs or Immigration New Zealand. That is why we ask readers not to resign a position, end a lease or commit money in the Gulf on the strength of a listing alone, and to wait for a confirmed offer and the necessary approvals.

The short probation notice works in your favour here. Fourteen days fits comfortably between a visa grant and most start dates abroad, so there is rarely a reason to resign early.

  • Australia: a subclass 482 holder who is outside Australia when the visa is granted must begin employment within 90 days of entering Australia. Our Skills in Demand 482 guide explains the streams and conditions.
  • New Zealand: Immigration New Zealand shows Accredited Employer Work Visa processing as 80% within 5.5 weeks. Treat that as a guide to pace, not a promise. An AEWV employment agreement also cannot include a trial period, which is worth checking in the agreement you are sent. Our AEWV guide walks through the employer-led process.

Before you sign anything, read the offer itself closely. JobFinder's checklist of what an Australia or New Zealand job offer must get right is a useful companion to this guide.

Whether your offer is for a boilermaker and metal fabricator role in Perth or a fitter, turner and welder position in Christchurch, the anchor is the start date in your signed offer. Count back from it, leave room for travel, and only then hand in your notice.

What fourteen days has to cover

Two weeks goes quickly when you are also packing a life. Three things need to happen in that window.

Final pay, without counting on gratuity

A private-sector worker who has served less than one year is not entitled to any end-of-service gratuity, and probation never runs past six months. Plan your budget around outstanding wages and other entitlements only. Your employer must pay all outstanding wages, other entitlements and any gratuity within 14 days of the contract ending. If you later move on from a longer role, our explainer on how end-of-service gratuity is calculated shows the full picture.

Visa cancellation, in the right order

Your employer first applies to MOHRE to cancel the labour contract and labour card, which you must also sign. The company has to submit a letter from you confirming that you received all wages and end-of-service benefits, so do not sign it until the money has arrived. The employer then applies to ICP, the Federal Authority for Identity, Citizenship, Customs and Ports Security, to cancel the residence visa.

ICP's cancellation of residency permits service lists an application fee of AED 50, a smart services fee of AED 100 and a processing time of 2 days. After cancellation, the standard grace period is 30 days, with 90 days for skilled workers in levels 1-3 and property owners, and 180 days for Golden, Green and Blue Residence holders among other listed groups. Staying beyond it costs AED 50 a day. Our guide to the UAE visa cancellation grace period helps you time the exit.

A police certificate, if you will need one

Home Affairs may ask for a police certificate from every country you lived in, usually where you lived there for at least 12 months in the past 10 years. If your total time in the UAE reaches that, plan for it now. The Ministry of Interior certificate needs an ID card issued in the UAE and is valid for 30 days, while Dubai Police also accepts applications from people outside the UAE who have entered before. See how UAE police clearance validity affects your timing before you choose.

A probation resignation plan, step by step

  1. Find your probation end date in your contract and confirm that you are still within it.
  2. Wait for the visa grant in writing: a grant notice from Home Affairs or Immigration New Zealand, not an email from a recruiter.
  3. Agree your start date with the overseas employer and count back to set your last working day, keeping a few spare days.
  4. If you think your employer has breached the contract, ask MOHRE how the one-year ban applies before you act.
  5. Give written resignation with at least 14 days' notice, stating that you are leaving the job and the UAE. Keep a signed or dated copy.
  6. Agree the final settlement figure, then confirm that the money has reached your account before signing the receipt letter.
  7. Sign the labour contract cancellation and follow the residence visa cancellation through to ICP.
  8. Collect any police certificate you need, then book your flight inside the grace period that applies to you.

While the details of the new role are fresh, update your CV too. Even a short UAE role needs a clear line explaining what you did and why you moved on, and Build AI CV can help you set it out cleanly for employers in Australia or New Zealand.

Common mistakes

  • Resigning on the strength of an interview. Until a visa is granted, the one-year ban leaves you with no fallback in the UAE if the plan stalls.
  • Giving notice by word of mouth. The law asks for prior written notice. A conversation alone leaves no record of when your 14 days began.
  • Telling your employer you are joining another UAE company. That route asks for at least one month's notice. Be clear that you are leaving the country.
  • Planning around a gratuity that is not due. Under one year of service, no end-of-service gratuity is payable.
  • Signing the wages receipt before payment. The letter confirms you were paid in full, so sign only once the money has arrived.
  • Treating the grace period as optional. Every day past it costs AED 50.

Frequently asked questions

How much notice do I give if I resign during probation to leave the UAE?

You must give prior written notice of 14 days if you resign during probation intending to leave the job and the UAE. Put it in writing and keep a dated copy, because the written notice is what starts the count.

Will I get a UAE work permit ban if I resign during probation?

Under Ministerial Resolution No. 47 of 2022, a worker who ends the employment relationship during probation without a breach by the employer cannot get a new UAE work permit for one year. If you think your employer breached the contract, ask MOHRE before you resign.

Can I come back to the UAE after resigning during probation?

If you return within three months on a new work permit, the new employer must compensate your previous employer for recruitment costs, unless they agree otherwise. The one-year work permit ban may also apply, so a quick return is rarely simple.

How long can probation last in the UAE?

In the UAE private sector, probation must not exceed six months. Check your contract for your own probation end date, because the notice rules change once it has passed.

Do I get end-of-service gratuity if I leave during probation?

No. A private-sector worker who has served less than one year is not entitled to any end-of-service gratuity. Your employer must still pay outstanding wages and other entitlements within 14 days of the contract ending.
